Tony Mokbel among gangland convictions at risk due to police use of lawyer as informant

A number of criminals could launch legal bids for freedom as a result of a secretive case of high-level police misconduct involving a defence barrister-turned-police informer duringMelbourne's bloody gangland war.

Court documents reveal the lawyer claimed to have helped police in as many as 386 cases, including that of notorious underworld figure Tony Mokbel, which could result in appeals from criminals applying to have their convictions quashed or sentences slashed.
At 9:00am (AEDT), suppression orders were lifted on a case decided in the High Court last month involving Victoria Police and the lawyer who represented numerous gangland figures, against the Victorian Director of Public Prosecutions.
The High Court judgement condemned Victorian police saying they were guilty of "reprehensible conduct" in encouraging the barrister to give up information about the accused and were involved in sanctioning "atrocious breaches of the sworn duty of every police officer".
"As a result, the prosecution of each convicted person was corrupted in a manner which debased fundamental premises of the criminal justice system," the court said.
Court documents revealed that the barrister, who represented Tony Mokbel and six of his associates, was also acting as a paid informant against her clients, and passing information about them to Victoria Police.
In 2015, after Mokbel and his associates were convicted, the Independent Broad Based Anti-Corruption Commission (IBAC) prepared a report for the Director of Public Prosecutions (DPP), recommending that it "consider whether any prosecutions had resulted in a miscarriage of justice as a result of the conduct of a barrister acting for those persons".

Police ruled risk of death to barrister was 'almost certain'

The DPP decided there was a duty to inform Mokbel and his associates that the barrister had given information to the police about them at the same time as she was acting for them.
The barrister — who cannot yet be named — also gave information to police about other clients she was acting for.
Those clients later made statements against some of the Mokbel group.
In the months that followed, Victoria Police undertook an assessment of the risk to the barrister if the DPP was to disclose the information to Mokbel and his associates.

The conclusion reached was that, if the information was disclosed, the risk of death to the barrister would become "almost certain".
On that basis, the then-chief commissioner of police and the barrister asked the court to restrain the DPP from making the disclosures, arguing that it would place the barrister and their family at "extreme risk of death or other harm", and "deter future informers from giving confidential assistance to police".
They lost the case, then lost again in the Court of Appeal, which found that the judge had properly taken account of the risks to the barrister and her family, and also the risk of deterring future informers.
The court found that the risks were outweighed by "the public interest in the right to a fair trial with the assistance of independent legal advice".
Last month, the High Court denied a final attempt to stop the DPP from providing the information to Mokbel and his associates, and revoked special leave to appeal.
In its judgement, the High Court accepted that "there is a clear public interest in maintaining the anonymity of a police informer".
However, the judgment also states that this situation is "very different, if not unique, and it is greatly to be hoped that it will never be repeated".

Lawyer involved in hundreds of cases

The court found that by covertly informing against her clients, while purporting to act as their defence lawyer, the barrister had committed "fundamental and appalling breaches" of her obligations.
The court accepted the magnitude of the risk to the barrister and her family, but noted that the barrister had declined to enter the police witness protection program, "taking the view that Victoria Police cannot be trusted to maintain confidentiality".
"If [the barrister] chooses to expose herself to consequent risk by declining to enter into the witness protection program, she will be bound by the consequences," the judgement said.
The lawyer claimed the information provided helped police in hundreds of cases.
"There were a total of 386 people arrested and charged that I am specifically aware of based upon information I provided to Victoria Police but there are probably more because as you would know, I did not always know the value or use of some of the intelligence that I was providing," the barrister said in a letter to police command.
The cases included convictions over the country's largest ecstasy haul, in which more than four tonnes of ecstasy was hidden in tomato tins, and other cases involving the "Mokbel clan".
Each of the barrister's clients will be sent a letter informing them that their lawyer was providing information "about you, in a possible breach of legal professional privilege and/or in breach of a duty of confidentiality," court documents revealed.
Tony Mokbel was sentenced to 30 years in prison in 2012 for masterminding an elaborate drug syndicate known as The Company.
He was arrested in Greece in June 2007, 15 months after fleeing Melbourne while on bail during a trial on cocaine importation charges.
In 2014, Daniel Andrews, who was the opposition leader at the time, refused to rule out holding a royal commission in a bid to restore faith in Victoria's justice system.
It is likely a Supreme Court judge will be appointed to review the cases to see if tainted intelligence or evidence was used to secure convictions or pressure people to plead guilty.
In 2015, a corruption watchdog investigation led by former Supreme Court judge Murray Kellam recommended the DPP consider if any convictions were compromised by police wrongdoing.
More than 30 people from rival underworld factions were killed during Melbourne's gangland war that raged between 1998 and 2010, as a result of a feud between drug kingpin Carl Williams and the Moran family.
Williams was himself clubbed to death by another inmate with the stem of an exercise bike in Barwon Prison in 2010.

FG begins insurance scheme for 104 unity colleges, pupils

The Federal Government said it had begun an insurance policy for the 104 Federal Government colleges in the country as well as the pupils.
It added that in the case of the death of a pupil, the parents or sponsors would be paid a one-off sum of N500,000 only.
The Minister of Education, Adamu Adamu, who stated this in Abuja in a statement obtained by SUNDAY PUNCH on Saturday, indicated that the pupils would pay N5,000 as their contribution.
Adamu said the government had started a “Student Welfare Insurance Scheme where pupils would pay N5,000 per session for the insurance cover.”
The minister added that the scheme was to ensure that no child dropped out of school on account of loss of parents or guardians.
Adamu, during the inauguration of the comprehensive insurance cover for the 104 unity schools, explained that three insurance underwriters had been enlisted, to whom the government would pay N198m.
He said the sum was to insure the school buildings and the academic content.
The minister noted that the insurance cover “for our unity schools has become the official policy of the Federal Government.”
He added, “The government has engaged insurance underwriters and brokers for the provision of the following class of insurance –Comprehensive Fire and General Peril cover for Buildings and Content of the 104 Federal Unity Colleges.
“Three insurance underwriters were appointed along with the brokers. Each of the underwriters will cover schools in the two zones (one zone from the North and the other zone from the South). The total Premium to be paid to the three underwriters and brokers is N198m only for the 104 Federal Unity Colleges.
“This will provide a total coverage of N900m only per school for buildings and N200m per school only for content.”
The minister added, “The students are to pay N5,000 only per session. The idea is to ensure that once a child is admitted into any of our Unity schools, that child will never drop out of school on account of loss of parents or guardians responsible for the payment of his or her school fees.
“In more specific terms, the policy provides for the following: Death of a student – in the case of death of a student, the parents or sponsor will be given a one-off payment in the sum of N500,000 only. In the case of death of parent or sponsor, the student will be paid the sum of N500,000 per session for a maximum of N2,500,000.
“In the case of accident of a student, N50,000 will be provided for medical expenses; and in the case of death of student or parents, N50,000 for burial expenses.”
Adamu said the government would ensure that all insurance companies involved in the scheme honoured their obligations as and when due.
He noted that the insurance policy was expected to increase enrolment in unity schools by 20 per cent.

THOUSANDS OF RABOBANK CUSTOMERS HIT WITH DOUBLE MORTGAGE DEDUCTIONS

Tens of thousands of Rabobank customers were met with a nasty shock on Saturday. Their savings mortgage payments were deducted twice. This happened due to human error and the amounts have since been refunded, a spokesperson for the bank said to NOS.
This concerned customers with a so-called build-up mortgage. The mistake resulted in many Rabobank customers starting the expensive December in the red, they complained on social media. 
The double debits were refunded retroactively, which means that people who ended up with a negative account balance due to the mistake will not have to pay interest on the overdraft, the spokesperson said to NOS.

Nebraska attorney has law license suspended

The Nebraska Supreme Court has indefinitely suspended the law license of a Holdrege attorney.
The Nebraska Counsel for Discipline says Kent Person repeatedly brushed off requests by a probate court and his client to administer an estate and made false statements about having taken action on the estate. His neglect of the case caused more than $1.1 million in federal, state and local penalties to accumulate. A second attorney had to be appointed by a probate court to administer the estate.
Person replied to the complaint by noting he was suffering from depression and was overwhelmed in his practice
Under the high court's decision Friday, Person can file for reinstatement after two years if he's fully paid back the penalties and fees. He would be required to serve two years' probation if he is reinstated.

The tattoo used to have the numbers “8414” … a badge number that belonged to Pete’s late father and firefighter who died in the September 11 attacks.

Ronaldo and Griezmann to sub Ballon d’Or ceremony

Juventus star Cristiano Ronaldo won’t attend tonight’s Ballon d’Or ceremony in Paris, Sky Sport’s Alessandro Alciato claims. The Portuguese star could be imitated by Atletico Madrid and France star striker Antoine Griezmann who is expected to be in the podium of the best players of last season.

According to Alciato, Cristiano Ronaldo has been voted as the second best player of 2018 after his former Real Madrid team-mate Luka Modric who is going to win the first Ballon d’Or of his career today.

Modric did also win the Fifa the Best award in September with Cristiano Ronaldo that didn’t attend the ceremony. Liverpool’s Mohammed Salah was awarded as the third best player of 2018 by Fifa.

France and Psg star Kylian Mbappé is expected to win the Ballon d’Or for Under 21 footballers although the Frenchman will be out of the ‘senior’ podium occupied by Modric, Ronaldo and Griezmann, another France World Cup winner.

The ceremony will take place in Paris tonight.

UEFA confirms VAR to be used in CL and EL knockout stages

Video Assistant Referees (VAR) technology will be used in the knockout stages of this season’s Champions League and Europa League competitions.
European football’s governing body confirmed the move following the meeting of its executive committee in Dublin.
VAR will also be used at next summer’s Nations League Finals – which will feature England as well as Portugal, Holland and Switzerland.
The Champions League last 16 gets under way in February next year.
UEFA president Aleksander Ceferin said: “We are ready to use VAR earlier than initially planned and we are convinced that it will be beneficial for our competitions as it will provide valuable help to match officials and will allow to reduce incorrect decisions.”

'He was robbed': Frank Warren to launch complaint over contentious Wilder v Fury decision

Frank Warren and the British Boxing Board of Control are to complain about the scorecards for Tyson Fury's drawn WBC heavyweight title fight with Deontay Wilder after the challenger was controversially denied victory.

The 30-year-old excelled throughout, impressively recovering from two knockdowns - the second remarkably heavy - but was harshly made the winner on only one of the three ringside judges after scores of 115-111 (in Wilder's favour), 112-114, and 113-113 resulted in a draw.
Victory would have represented the completion of one of the finest comebacks in the history of the sport but, even with a rematch inevitable, Fury's promoter and the BBBC will move to protect their fighter's interests.
"I've spoken to Charlie Giles, president of the British Boxing Board of Control and they, along with us, will be writing to the WBC asking that they look at what's gone on there and to order the rematch," Fury's promoter Warren said.
“The Mexican judge (Alejandro Rochin) got it wrong. I genuinely feel sorry for Tyson. He’s been robbed and it wasn’t right,” Warren added.
Even amid the fact that for the first time Fury did not win, the nature of the fight — significantly more entertaining than when he awkwardly defeated Wladimir Klitschko — means Fury’s reputation is at its greatest.
Reflecting on what unfolded at Los Angeles’ Staples Center, the 30-year-old then said: “It was a great performance, if I do say so myself.
“I’m very happy with the fight, but put it this way, if I didn’t get knocked down twice in that fight, on one of the judge’s scorecards I’d have still lost, so he needs banning from boxing forever because he clearly can’t judge.
“Rochin, you need sacking, or to go to Specsavers, mate. Even without the knockdowns he still had me losing the fight.
“I’ve never seen a worse decision in my life. I don’t know what fight those judges were watching; the guy who gave it 115-111, I don’t know what he was watching. It ain’t the first time this has happened.
“That’s as bad a decision as the first Lennox Lewis-Evander Holyfield fight (in 1999), but who am I to say anything? I’m just a fighter, I’m not the judges.
“You can’t take anything away from me or Wilder; we done our best. But it’s stuff like this that gives boxing a bad name.”
Fury was unable to explain how he got back to his feet after the heavy 12th-round knockdown by Wilder that appeared to have left him unconscious.
“I don’t know how I got up. I had a holy hand upon me, that brought me back, and I’ve got a fighting spirit and I never say die, I get back up,” he said.
“Even in the 12th round when I got knocked down heavy, I got back up and probably won the round, fought back and wobbled him a bit.
“I was brought back. I rose to my feet from the brink of defeat. I can’t tell you (how I did it) because I don’t know.

Southampton sack Mark Hughes after draw with Manchester United

Mark Hughes has been sacked by Southampton after Saturday evening's 2-2 draw with Manchester United.
The Saints have won just one of their last 12 games in all competitions; a penalty victory over Everton in the League Cup back in October.
Hughes' side were 2-0 up on United over the weekend, before surrendering their advantage. The draw lifted the south coast side to 18th in the table, now a point above basement side Fulham.
"Southampton Football Club can today confirm it has parted company with First Team Manager Mark Hughes," said a club statement.
"Assistant First Team Manager Mark Bowen and Assistant First Team Coach Eddie Niedzwiecki have also left the club. We would like to express our thanks to Mark and his staff for all of their efforts during their time at St Mary’s. The search for a new manager to take the club forward is already under way."
First Team Assistant Coach Kelvin Davis will take charge of the team for Wednesday’s Premier League game against Tottenham Hotspur at Wembley.
Northern Ireland captain Steven Davis will be hoping the new man in charge will give him more game-time. The 33 year-old has played just a handful of minutes of Premier League football this season, making only his second substitute appearance of the campaign against United as he was brought on in injury-time. Davis has made just one start in all competitions, against Brighton in the League Cup back in August.

The outfit consisted of 1970’s style skin-tight trousers which turned into ruffled flares and a matching top which tied-up a the front.
One half on the ensemble had monochrome stripes with colourful flowers and the other side featured white and multicoloured flowers on a black background.

Katy Perry pays $50,000 for date with Orlando Bloom as she outbids fan at auction

Katy Perry has paid $50,000 (£39,000) for a date with her boyfriend Orlando Bloom, after outbidding a fan at a charity auction. 

The singer, who rekindled her romance with the actor earlier this year (18), took to the stage at the One Love concert in Malibu, California on Sunday (02Dec18) to encourage audience members to bid on a motorcycle ride and lunch with her beau. 

"That also means that when you're on the motorcycle with him, you're holding him in a way that I am not excited about! You're holding his pecs and his six-pack - and it's so glorious!" she told the crowd. "You get to hold on to Orlando for about 45 minutes... And then, you get to stare into his brown eyes!" 

A bid then came in for $20,000 (£15,600) from a woman called Laura, at which point Katy shrieked: "Yay! I don't know who you are, but stan for my man!" 

However, the jealousy then appeared to be too much to handle, as the 34-year-old jumped in and said: "Laura, I'm sorry - I'm buying it for $50,000." 

The auctioneer confirmed the American Idol judge's winning bid as he declared, "Sold - to the lady in the red leather skirt!" 

Katy had earlier performed at the charity concert, held at the King Gillette Ranch in Calabasas, which was organised to raise funds following the devastating wildfires in the state of California last month. 

Revealing her keyboard player Ty Bailie had lost his home in the blazes, Katy explained: "I'm really here because of this guy. This guy is my friend, and we've been on tour for the past couple of years, and he lost his house in the fires. 

"But he's got the greatest attitude and perspective in life and he's the coolest guy, and I'm really just here for him - and for everyone else that has been affected by this horribleness. But we have an opportunity to grow together now. I love you so much." 

Other performances at the benefit concert came from Robin Thicke, Alanis Morissette, Rita Ora, and Gwen Stefani, with money raised from the event split between the One Love Malibu fund and The Malibu Foundation.

Aubameyang: I am as good as Golden Boot rivals Harry Kane and Mohamed Salah

Pierre-Emerick Aubameyang warned his Golden Boot rivals his best is still to come, after scoring twice in Arsenal’s 4-2 win over Tottenham.
The forward now tops the Premier League scoring charts with 10 goals.
In the previous four seasons, the Premier League Golden Boot has been dominated by Harry Kane, Sergio Aguero and Mohamed Salah — and Aubameyang believes he is on the same level as his rivals.
Told that he is the first player to score with 10 consecutive shots on target in the Premier League since Blackburn’s Benni McCarthy in 2007, Aubameyang said: “Wow, not bad, eh? And I think I’m not at 100 per cent. I’m really happy because my best form is coming. Yesterday I felt very good on the pitch.
“I hope I’m at the same level [as Kane, Aguero and Salah] and I think so, yes. 
“It’s early in the season. We have good strikers in the Premier League, so it will be tough [to finish as top scorer]. But I’m happy we won yesterday. The most important thing is the team.”
The Gabonese has switched between centre-forward and the  left wing under Gunners coach Unai Emery and he believes the key to his form has been a return to the middle, having started centrally against Bournemouth last weekend and Spurs.
“Everybody knows it — I like to  play up front, where I know that I  can help the team. Sometimes the coach puts me on the left side but centre-forward is my favourite position,” said Aubameyang, who joined Arsenal last January from Borussia Dortmund.
“Of course, I expected this [form]! Because the team have helped me to settle in good. It [my move to Arsenal] has gone well. I’m really happy here. We played like a team and we did well yesterday.”
In another testament to the change in mood at the club under Emery, Aubameyang said he had never experienced the Emirates Stadium as loud as it was for yesterday’s victory over their north London rivals which took Arsenal into the top four.
“It’s the first time it has been like that [for me],” said the 29-year-old, who opened the scoring yesterday with a penalty and then made it 2-2.
“Okay, against Atletico Madrid last season [in the Europa League  semi-final first leg] was really nice but yesterday was the best atmosphere I’ve experienced on the pitch.
“That’s what I like about the Premier League, of course. I think it’s the greatest league in the world — it’s a great challenge for me and I’m happy to score goals. I think it’s good for us. 
“We knew that if we won this game we’d be in the top four. It’s great now. We have to look forward because we have an important game on Wednesday [against Manchester United]. We know that it’s tough to stay in the top four.”
